2. Data processing for the purposes of performing the contract, establishing contact

2.1 Data processing for the purposes of performing the contract

For the purpose of performing the contract (including enquiries regarding the processing of any existing warranty and performance fault claims as well as any statutory updating obligations) in accordance with Art. 6 (1) (b) GDPR, we collect personal data if you provide it to us voluntarily as part of your order. Mandatory fields are marked as such, as in these cases we necessarily need the data to process the contract and we cannot send the order without their specification. Which data is collected can be seen from the respective input forms.

Further information on the processing of your data, in particular on the forwarding of the data to our service providers for the purpose of order, payment and shipping, can be found in the following sections of this privacy policy. After complete processing of the contract, your data will be restricted for further processing and deleted after expiry of the retention periods under tax and commercial law in accordance with Art. 6 (1) (c) GDPR, unless you have expressly consented to further use of your data in accordance with Art. 6 (1) (a) GDPR or we reserve the right to use data beyond this, which is permitted by law and about which we inform you in this privacy policy.

2.2 Customer account

Insofar as you have given your consent to this in accordance with Art. 6 (1) (a) GDPR by deciding to open a customer account, we will use and store your data for the purpose of opening the customer account as well as for further future orders on our website. Deletion of your customer account is possible at any time and can be done either by sending a message to the contact option described in this privacy policy or via a function provided for this purpose in the customer account. 2.3 Establishing contact

As part of our customer communication, we collect personal data in order to process your enquiries in accordance with Art. 6 (1) (b) GDPR if you voluntarily provide us with this data when contacting us (e.g. via contact form or e-mail). 3. Data processing for the purposes of shipment

We forward your data to the shipping company within the scope required for the delivery of the ordered goods according to Art. 6 (1) (b) GDPR.

In order to ship goods to you, we transfer your address and contact data, when necessary, to parcel delivery companies (Hermes UK, Royal Mail, Seven Senders) This includes the name, company (if applicable) as well as the postal address/Packstations and any additional information regarding the address. The legal basis for the transmission is the performance of the contract with you, Art. 6 (1) (b) GDPR.

For returns we offer a voluntary service of generating the postage and return label via our website. To generate the label, you will be forwarded from our website to Royal Mail returns portal. In order to provide you with the best possible service, we transfer personal data from your order that is necessary for creating the return label (i.e. receipt number, zip code, name, address and e-mail address). This information is required for correctly filling in the label and sending it to you via e-mail so that you can print it. While this eliminates the need for you to enter this information yourself, it does require us to forward the information to Royal Mail. The legal basis for the transmission is the provision of a service requested by you, Art. 6 (1) (b) GDPR.

Furthermore, we use the services of parcelLab in order to take over the dispatch notifications towards our customers and to inform them about the dispatch status and the tracking number of their order. For this purpose, the personal data necessary for tracking the shipment (name, street, postal code, city, country, telephone number and e-mail, order number, product number, shipment number and selected service provider) will be forwarded to parcelLab. Data forwarded to parcelLab will be deleted automatically after 90 days.

4. Data processing for the purposes of payment

As part of the payment process in our online shop, we work together with these partners: technical service provider, credit institution, payment service provider.

4.1 Data processing for the purposes of transaction processing

Depending on the selected payment method, we forward the data necessary for processing the payment transaction to our technical service providers, who act for us on the basis of processing on our behalf or to the authorised credit institutions or to the selected payment service provider insofar as this is necessary for the payment process. 4.3 Comment function

In order to give you the opportunity to get in contact with us and other users and to write your own opinion about our articles, we operate a commentary tool in our magazine area https://www.bergzeit.fr/en/journal/. This tool enables you to comment on our articles and to initiate or lead a discussion with other users. In the tool we enter the following data from you:

We would like to point out that we evaluate your user behaviour when sending the newsletter. For this purpose, we also analyse your interaction with our newsletter by measuring, storing and evaluating opening rates and click-through rates for the purpose of designing future newsletter campaigns ("newsletter tracking").

For this evaluation, the emails sent contain single-pixel technologies (e.g. so-called web beacons, tracking pixels) that are stored on our website. For the evaluations, we link the following "newsletter data" in particular

Within our online offer, on the basis of your consent within the meaning of Art. 6 para. 1 lt. a. GDPR, the technology of Emarsys eMarketing Systems GmbH (Stralauer Allee 6, 10245 Berlin, Germany) is used. Emarsys works through cookies and tracking pixels, which generally support the purpose of Emsarsys to create newsletters and advertisements that are tailored to you and your interests. Provided that you have given your consent to receive our newsletter and have fully undergone the associated double opt-in process for verification, the data collected by Emarsys via cookies will be combined into a user profile which can also be personally assigned to you via your e-mail address. We use existing information such as confirmation of receipt and reading of e-mails, information about computers and connections to the Internet, operating system and platform, your surfing history, date and time of your visit to the homepage, products/articles you have visited. Furthermore, all historical purchase data since July 2016 has been linked to Emarsys. We use this information exclusively in pseudonymized form. You will thus receive advertising with our newsletters that is individually tailored to your interests. 7.1 Use of Adobe services for webanalysis and advertising purposes

We use the technologies described below from Adobe Systems, Software Ireland Limited, Ireland, 4-6 Riverwalk, Citywest Business Campus, Dublin 24, Ireland ("Adobe"). The information automatically collected by Adobe technologies about your use of our website is generally transmitted to and stored on a server operated by Adobe, Inc, 345 Park Avenue San Jose, CA 95110-2704, USA. For the USA, there is no adequacy decision of the European Commission. Our cooperation is based on standard data protection clauses of the European Commission.  Adobe Fonts

We have no influence on this subsequent data processing.  The data processing is carried out on the basis of an agreement between jointly responsible parties in accordance with Art. 26 GDPR.

7.2 Use of Google services for web analysis and advertising purposes

We use the following technologies of Google Ireland Ltd, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). The information automatically collected by Google technologies about your use of our website is usually transferred to a server of Google LLC, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA and stored there. There is no adequacy decision with respect to the USA by the European Commission. Our cooperation is based on standard data protection clauses adopted by the European Commission. If your IP address is collected using Google technologies, it will be shortened by activating IP anonymisation before being stored on Google's servers. Only in exceptional cases will the full IP address be transferred to a Google server and shortened there.  Google Analytics

For the purpose of website analytics, Google Analytics automatically collects and stores data (IP address, time of visit, device and browser information as well as information on your use of our website), from which usage profiles are created using pseudonyms. Cookies can be used for this purpose. Your IP address will not be merged with other data from Google. The data processing is based on a data processing agreement with Google.

In order to optimize the marketing of our website, we have activated the data sharing settings for "Google products and services". This allows Google to access the data collected and processed by Google Analytics and then use it to improve Google services. The data sharing to Google within the scope of these data sharing settings is based on an additional agreement between the data controllers.  YouTube Video Plugin

In order to integrate third party content, data (IP address, time of visit, device and browser information) are collected via the YouTube Video Plugin in the expanded data protection mode used by us, transmitted to Google and then processed by Google only when you play a video.


7.3 Use of Microsoft services for web analytics and advertising purposes

Anonymous measured values are collected in the process. The access number measurement alternatively uses a session cookie or a signature, which is generated from various automatically transmitted information of your browser, for the recognition of computer systems. IP addresses are only processed in anonymized form.

The procedure was developed in compliance with data protection. The sole aim of the procedure is to determine the probability of individual texts being copied.

At no time are individual users identified. Their identity always remains protected. You will not receive any advertising via the system.

Competitions

Within our online offer, in order to fulfil the contract (i.e. provision of competitions within the meaning of Art. 6 I according to a DS-GVO), we will, on the basis of our legitimate interests (i.e. interest in increased customer loyalty and marketing within the meaning of Art. 6 para. 1 lt. f. GDPR) from time to time link to our partners' competitions. In order to take part in a competition, we ask you for the following data:

Before we store your data, we will ask you for your consent for the stated purpose. As part of this consent, we will inform you about the individual conditions of participation, which transfer and processing conditions apply to the respective competition. We will store this data within the framework of the legal obligation to provide evidence on the basis of Art. 6 I lt. c DS-GVO. Your data will be deleted after expiry of the duty of proof.

Deactivation of Cookies

In order to make visiting our website attractive and to enable the use of certain functions, to display suitable products or for market research, we use so-called cookies on various pages. This takes place on the basis of your consent pursuant to Art. 6 para. 1 sentence 1 lit. a GDPR. Cookies are small text files which are automatically stored on your end device. 8. Integration of the Trusted Shops Trustbadge / other widgets

Trusted Shops widgets (e.g. Trusted Shops Trustbadge) are integrated in this website to display Trusted Shops services (e.g. Trustmark, collected reviews) and to offer Trusted Shops products to buyers after they have placed an order.

This serves to protect our legitimate interests in optimized marketing by enabling secure shopping in accordance with Art. 6 (1) (f) GDPR, which prevail in the context of a balancing of interests. The trust badge and the services advertised with it are an offer of Trusted Shops GmbH, Subbelrather Str. 15C, 50823 Cologne (Trusted Shops). We and Trusted Shops are joint controllers in data protection terms pursuant to Art. 26 GDPR. In the following section, we inform you about the essential contents of the joint controllership agreement according to Art. 26 (2) GDPR.

The trust badge is provided as part of a joint controllership by a US CDN provider (content delivery network). An adequate level of data protection is ensured by standard data protection clauses and other contractual measures. Further information on the privacy policy of Trusted Shops GmbH can be found here.

When the Trustbadge is viewed, the web server automatically saves a so-called server log file, which also contains your IP address, the date and time of access, the amount of data transferred and the requesting provider (access data) and documents the access. The IP address is anonymized immediately after collection, so that the stored data cannot be assigned to your person. The server log file is stored in a security database for the analysis of security anomalies and automatically deleted or anonymized not later than 90 days after creation. According to Art. 6 (1) (f) GDPR, this serves the our and Trusted Shops' legitimate interests to prevent cases of misuse and fraud, to optimize our offers and websites, and to ensure trouble-free operation of the website, the Trustbadge and other Trusted Shops widgets.

Further personal data is transferred to Trusted Shops GmbH if you decide to use Trusted Shops products after completing an order or if you have already registered to use them. For this purpose, personal data is automatically collected from the order data. To check automatically whether you as a buyer are already registered for product use, a neutral parameter, e.g. the e-mail address hashed by cryptological one-way function, is used. The e-mail address is converted into this hash value, which cannot be decrypted by Trusted Shops, before it is transmitted. After checking for a match, the parameter is automatically deleted.

This serves to check whether you are already registered for services with Trusted Shops GmbH and is therefore necessary to safeguard our and Trusted Shops' prevailing legitimate interests in the fulfillment of the buyer protection linked to the specific order and the transactional review services pursuant to Art. 6 (1) (f) GDPR. If this is the case, further processing will be carried out in accordance with the contractual agreement between you and Trusted Shops. If you have not yet registered for the services, you will be given the opportunity to do so for the first time. Further processing after registration also depends on the contractual agreement with Trusted Shops. If you do not register, all transmitted data is automatically deleted by Trusted Shops and a personal reference is then no longer possible.

Our presence on social networks and platforms serves to improve active communication with our customers and interested parties. There we inform about our products and current special offers.

When you visit our online presence in social media, your data may be automatically collected and stored for market research and advertising purposes. So-called user profiles are created from this data using pseudonyms. These can be used, for example, to place advertisements within and outside the platforms that presumably correspond to your interests. For this purpose, cookies are usually used on your end device. The visitor behaviour and interests of the users are stored in these cookies. This serves according to Art. 6 Para. 1 lit. f. GDPR, this serves to safeguard our legitimate interests, which predominate in the context of weighing up interests, in an optimized presentation of our offer and effective communication with customers and interested parties. Right to object
If we process personal data as described above to protect our legitimate interests that are overriding in the process of balancing of interests, you may object to such data processing with future effect. If your data are processed for direct marketing purposes, you may exercise this right at any time as described above. If your data are processed for other purposes, you have the right to object only on grounds relating to your particular situation.

After you have exercised your right to object, we will no longer process your personal data for such purposes unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defence of legal claims.

This does not apply to the processing of personal data for direct marketing purposes. In such a case we will no longer process your personal data for such purposes.

For all pictures used on our homepage, the authorship is named in the picture itself. According to § 15 UrhG and § 19a UrhG, Bergzeit GmbH is the author of all pictures without a name.
